(1) These Terms of Service (hereinafter "Terms") apply to the use of the learning platform "Typr" (hereinafter "Service" or "Platform"), operated by Emanuel Schmacher (hereinafter "Provider").
(2) These Terms apply to all users of the Platform, regardless of whether use is free or paid.
(3) Deviating, conflicting or supplementary terms of the user shall not become part of the contract unless their validity is expressly agreed to in writing.

(1) Typr is a web-based learning platform for learning touch typing.
(2) The Platform offers the following features:
(3) The basic version of Typr is free to use. The Provider reserves the right to offer certain premium features for a fee.
(4) The Provider is entitled to change, expand or restrict individual features of the Platform at any time, provided this is reasonable for the user.
(1) On the Platform, users can earn virtual coins through training sessions and completing levels. These coins are an in-game currency with no real monetary value.
(2) Coins can be used within the Platform for:
(3) Coins cannot be exchanged for real money, transferred to other users or used outside the Platform.
(4) The Provider reserves the right to adjust the number of earnable coins, the prices for virtual content and the coin system at any time.
(5) The purchase of coins with real money is currently not possible. Should this option be introduced in the future, additional terms will apply, about which the user will be informed separately.

(2) Every new Pro subscription begins with a free trial period of 3 days. During the trial period, the subscription can be cancelled at any time without cost. After the trial period expires, the first payment is automatically charged.
(3) Payment processing is handled by the payment service provider Mollie B.V. Accepted payment methods are: credit card, PayPal, Apple Pay and Google Pay.
(4) Payment is charged in advance for the respective billing period (month or year). For monthly billing, the amount is charged on the same day each month.
(5) In case of a failed payment, we grant a grace period of 3 days. During this time, Pro status remains active. If payment is not successfully completed within the grace period, Pro status will be automatically deactivated.
(6) The subscription can be cancelled at any time at the end of the current billing period. Cancellation is done through the account settings on the Platform. After cancellation, Pro status remains active until the end of the paid period.
(7) The Provider is a small business pursuant to § 6 para. 1 no. 27 UStG (Austria). Therefore, no VAT is shown. All stated prices are final prices.

(1) The use of Typr requires registration and the creation of a user account.
(2) The following information is required for registration:
The display name is the publicly visible name of the user, shown in leaderboards, multiplayer games and other social features of the Platform.
The date of birth is collected for the following reasons:
The date of birth is not publicly displayed and is only used for internal purposes.
(3) The user is obligated to provide truthful information during registration and to update it in case of changes.
(4) The user is responsible for keeping their login credentials confidential. Sharing with third parties is not permitted.
(5) The Provider reserves the right to reject registration without stating reasons or to suspend or delete user accounts in case of violations of these Terms.
(1) The basic version (free plan) of Typr is free to use and without daily practice limits.
(2) Pro subscribers receive access to additional premium features.
(3) The Provider reserves the right to adjust the feature scope of the plans. Users will be informed of significant changes.
(1) Users can send friend requests to other users via username. A friendship is only established after mutual confirmation.
(2) Friends can challenge each other to typing duels. Participation in a duel is always voluntary.
(3) In the friends list and friends leaderboard, display name, avatar, XP points and daily streak are shown. Email addresses or other personal data are not shared.
(4) Users can end friendships unilaterally at any time. Sent requests can be withdrawn.
(5) It is prohibited to use the friends list feature for harassment, spam or other abusive purposes.
(1) To use the classroom feature, a user account must be activated as "Teacher". Activation can be requested through the contact form on the "For Teachers" page or by email to the Provider. The Provider reserves the right to reject activation.
(2) Teachers can create classrooms and provide students with invitation codes.
(3) Students join a classroom voluntarily by entering the invitation code. Joining can be done through the settings page.
(4) Teachers can view their students' learning progress, including: display name, typing speed (WPM), accuracy and completed assignments.
(5) Students in the same classroom do not have access to other students' data. Only the assigned teacher can view the performance data of all students in the classroom.
(6) Teachers can create and assign tasks to students. Task completion is automatically tracked based on the students' training results.
(7) Teachers can export class data as a CSV file. Only display names and performance data are exported, no personal contact data.
(8) Students can leave a classroom at any time. The teacher can remove students from the classroom.
(1) The Provider may conduct time-limited seasonal events with increased XP rewards (multipliers). Participation is automatic and free for all users.
(2) Tournaments are organized competitions with a bracket system (4, 8 or 16 participants). An entry fee in virtual coins may be charged for participation.
(3) Tournament results (display name, placement, game results) are shown to all tournament participants and on the event leaderboard.
(4) The Provider reserves the right to change or cancel tournaments or events without prior notice if technical or organizational reasons require it.

(1) The Provider grants the user a simple, non-transferable, non-sublicensable right to use the Platform for personal, non-commercial use.

(3) The Provider is not liable for damages caused by unavailability of the Platform, insofar as the unavailability is not the Provider's responsibility.
(1) The Provider is liable without limitation for damages resulting from injury to life, body or health, as well as for intent and gross negligence.
(2) In case of slight negligence, the Provider is only liable for breach of a material contractual obligation and only for the foreseeable, typical contractual damage.
(3) Any further liability is excluded to the extent permitted by law.
(4) The above limitations of liability also apply in favor of the Provider's vicarious agents.
(5) The Provider assumes no liability for learning outcomes or achieving certain typing speeds.
(1) The user can terminate their user account at any time without giving reasons. Termination can be done through account settings or by email.
(2) The Provider can terminate the usage relationship with 14 days' notice at the end of the month.
(3) The right to extraordinary termination for good cause remains unaffected for both parties. A good cause exists in particular in case of:
(4) After termination of the usage relationship, all personal data of the user will be deleted, unless statutory retention obligations apply.
(1) The Provider reserves the right to change these Terms at any time, provided the change is reasonable for the user taking into account the Provider's interests.
(2) Changes will be communicated to the user by email no later than four weeks before the planned effective date.
(3) If the user does not object within four weeks of receiving the notification, the amended Terms are considered accepted.
(4) In case of objection, the Provider may terminate the usage relationship at the time the amended Terms take effect.
(1) The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) The place of jurisdiction for all disputes arising from this contractual relationship is, to the extent permitted by law, the Provider's registered office.

(4) The Provider is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
(5) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
